WOOD v. U.S
JAY C. ZAINEY, Senior District Judge
In accordance with the Court's Minute Entry of March 3, 2004, granting summary judgment in favor of the United States and the Judgment entered March 11, 2004, the United States moves the Court for disbursement of the funds held in the Court's registry with respect to the above-named interpleader action. Although the United States and the plaintiffs agreed in their cross motions for summary judgment that funds in the principal amount of $27,064.36 are available for distribution, the Clerk's office has informed undersigned Tax Division counsel that the registry actually holds the principal amount of $27,290.35 for distribution in this action. Because the first priority claim of the United States exceeds that amount, and based on the Court's order granting summary judgment, the United States is entitled to receive the entirety of those funds to apply to the outstanding federal tax liability of Frank P. Crochet. A proposed order for disbursement accompanies this motion.
ORDER FOR DISBURSEMENT OF FUNDS
In accordance with the Court's Minute Entry of March 3, 2004, granting summary judgment in favor of the United States and the Judgment entered March 11, 2004, the Clerk of Court is authorized and directed to draw a check on the funds on deposit in the registry of this Court in the principal amount of $27,290.35 plus all interest earned less the assessment fee for the administration of funds, payable to the United States of America, and mail the check to Laura M. Conner, Trial Attorney, Tax Division, United States Department of Justice, at P.O. Box 14198, Ben Franklin Station, Washington, D.C. 20044.
THUS DONE AND SIGNED.
