ANDREWS v. PRICHARD HAWKINS YOUNG, 04-03-00889-CV (Tex.App.-San Antonio 4-7-2004)

Court of Appeals of Texas, Fourth District, San Antonio.
Apr 7, 2004
MEMORANDUM OPINION

PER CURIAM.

Appellant Gilbert Andrews's brief, which was due on February 23, 2004, has not been filed. On March 8, 2004, we ordered appellant, on or before March 18, 2004, to file his appellant's brief and a written response reasonably explaining (1) his failure to timely file the brief and (2) why appellee is not significantly injured by his failure to timely file a brief. We warned that if appellant failed to file his brief and the written response by the date ordered, we would dismiss the appeal for want of prosecution. Appellant did not respond, nor did he file his brief. The appeal is, therefore, dismissed for want of prosecution. See Tex.R.App.P. 38.8(a)(1), 42.3(b). Costs of appeal are taxed against appellant.
