IT IS ORDERED:

1) Defendant's motion for judgment as a matter of law is granted. Plaintiff's third amended complaint (Filing No. 535) as amended on September 26, 2003, is dismissed.

2) Motion for pro hac vice admission (Filing No. 679) and motion to submit amici brief (Filing No. 680) are denied.

3) All other pending motions are denied as moot.
