McMILLAN, Presiding Judge.
Pursuant to the Alabama Supreme Court's decision in Ex parte Smith, 891 So.2d 286 (Ala. 2004), the judgment is due to be reversed and the cause remanded to the trial court for proceedings consistent with that opinion.
REVERSED AND REMANDED.
COBB, BASCHAB, SHAW, and WISE, JJ., concur.
