This final judgment is entered pursuant to FED. R. CIV. P. 58 and the court's "Order Granting Defendant's Motion for Summary Judgment and Denying Fleming Companies, Inc.'s Motion for Summary Judgment," signed on June 4, 2004.

In accordance with the rulings set forth in the above-referenced order, it is ORDERED that the plaintiff shall take nothing by virtue of and from the defendant and that costs be taxed against the plaintiff.
