DECISION PURSUANT TO RULE 1:28

The order of the single justice affirming the trial judge's order awarding fees under G.L.c. 231, § 6F, is reversed. The order awarding fees is reversed, and a new order is to enter in Superior Court denying the motion to assess attorney's fees and costs under that section. Further appellate review granted 442 Mass. 1108 (2004).
