VT, INC. v. GEICO GENERAL INSURANCE COMPANY (N.D.Tex. 2004)

Pursuant to the Memorandum Opinion and Order filed on June 16, 2004, the Court issues judgment as follows:

Plaintiff VT, Inc. as Trustee for World Omni, L.T. is awarded judgment in the amount of $47,210.22 against GEICO General Insurance Company on Plaintiff's breach of contract claim;

Autoflex Leasing — Dallas L.P. is granted a declaratory judgment that its agreement with VT, Inc. as Trustee for World Omni, L.T. regarding the prosecution of this law suit was not a breach of the Agreed Motion for Dismissal in Civil Action No. 3:02-CV-1515-H and was not otherwise improper;

GEICO General Insurance Company takes nothing from its counterclaims against VT, Inc. as Trustee for World Omni, L.T. and Autoflex Leasing — Dallas L.P.; and

Plaintiff VT, Inc. is awarded prejudgment interest on its breach of contract claim at the rate of 6% per annum simple interest to run from March 29, 2000 through June 16, 2004, and post-judgment interest at the rate of 1.02% will run from June 17, 2004 until the judgment is paid. Costs are awarded against GEICO.
