WHEREAS plaintiff class members Richard Entenmann and Shari Galitzer ("Movants") did not request exclusion from the plaintiff class in the above-referenced action by the September 1, 2004 deadline established by the Court;

WHEREAS on or about October 26, 2004, Movants submitted an application to this Court for an order declaring that Movants are excluded from the plaintiff class or, in the alternative, extending the time for Movants to request exclusion from the plaintiff class; and

WHEREAS a hearing on Movants' application was held on October 28, 2004;

IT IS HEREBY ORDERED that for the reasons stated on the record at the October 28 hearing, Movants' application is DENIED.
