This action came on for hearing before the Court, on December 6, 2004, Hon. Manuel L. Real, District Judge Presiding, on a Motion for Summary Judgment by Homestead Insurance Company, Inc., and the evidence presented having been fully considered, the issues having been duly heard and a decision having been duly rendered,

IT IS ORDERED AND ADJUDGED that plaintiff The Casden Company ("Casden") take nothing by its complaint and judgment is entered in favor of Homestead. Additionally, judgment is entered in favor of Homestead in its declaratory relief action. Homestead shall recover its costs.
