Upon consideration of defendants' motion [28] to dismiss and for summary judgment, the opposition, reply, and sur-reply thereto, and for the reasons set forth in the accompanying Memorandum Opinion in this case issued this date, it is hereby

ORDERED that defendants' motion for summary judgment is granted;

ORDERED that defendants' motion to dismiss is denied as moot;

ORDERED that judgment is hereby entered for the defendant, dismissing this case with prejudice.
