IN RE HA 2003, INC. (Bankr.N.D.Ill. 2005)
STIPULATION AND ORDER MODIFYING PRETRIAL SCHEDULE WITH RESPECT TO THE OBJECTION OF THE HA2003 LIQUIDATING TRUST TO THE CLAIMS OF KELLOGG USA, INC. (CLAIM NOS. 36 AND 651)

THIS STIPULATION is made by and between the HA2003 Liquidating Trust (the "Liquidating Trust") and Kellogg USA, Inc. ("Claimant"), and is made with reference to the following facts:
A. On or about September 11, 2001, Claimant filed a proof of claim against HA-LO Industries, Inc. in the amount of $784,877.50, which claim was assigned Claim No. 36 on the official claims register in the above-captioned substantively consolidated cases ("Claim No. 36").
B. On or about May 21, 2002, Claimant filed a proof of claim against HA-LO Industries, Inc. in the amount of $784,877.50, which claim was assigned Claim No. 651 on the official claims register in the above-captioned substantively consolidated cases ("Claim No. 651", and together with Claim No. 36, the "Claims").
C. On or about May 24, 2004, the Trust filed its Objection To And Request For Disallowance Of Claims Filed By Kellogg USA, Inc. (Claim Nos. 36 and 651) (the "Objection"), in which the Liquidating Trust sought an order disallowing the Claims in their entirety.
D. On October 19, 2004, the above-captioned bankruptcy court issued an order establishing certain pretrial deadlines.
E. On February 16, 2005, the above-captioned bankruptcy court entered a stipulation and order modifying certain pretrial deadlines.
F. The parties are engaged in settlement discussions and desire additional time to pursue a resolution of this matter without the need to engage in extensive discovery.
NOW THEREFORE, in consideration for the foregoing facts, which are incorporated herein, the parties stipulate and agree as follows:
1. The deadline for the Liquidating Trust to respond to Claimant's discovery requests shall be extended until June 1, 2005.
2. The discovery deadline applicable to the Objection shall be extended from June 30, 2005 to and including August 31, 2005.
3. The status hearing on the Objection currently scheduled for April 19, 2005 at 2:00 p.m shall be continued to June 28, 2005 at 2:00 p.m.
IT IS SO ORDERED.
