This matter having come before the Court upon the motion of Plaintiff to suspend issuing a final ruling in this case until Plaintiff has completed discovery as well as the motion of the United States of America for summary judgment; and the Court having considered the parties' submissions; and for the reasons stated in the Opinion of today's date; and for good cause shown;

IT IS this 5th day of April, 2005 hereby

ORDERED that Plaintiff's motion to suspend issuing a final ruling in this case until Plaintiff has completed discovery [Docket Item No. 5-1] shall be, and hereby is, DENIED ; and

IT IS FURTHER ORDERED that Defendant United States of America's motion for summary judgment [Docket Item No. 4-1] shall be, and hereby is, GRANTED ; and

IT IS FURTHER ORDERED that the Clerk of Court shall close this case on his docket.
