This cause coming to be heard on the Post-Confirmation Committee (the "PCC") of Unsecured Creditors of HA2003, Inc., et al.'s Tenth Omnibus Objection To Claims (the "Objection"); the PCC having objected to claims filed by Heritage Industries ("Heritage") on the basis of 11 U.S.C. § 502(d) insofar as the PCC obtained a default judgment against Heritage; the Objection having been continued from time to time; ASM Capital L.P., Inc. ("ASM") having purchased the claims of Heritage; and the PCC and ASM now having reached a resolution of these matters; IT IS HEREBY AGREED AND ORDERED THAT:

1. Claim no. 31358 belonging to ASM shall be allowed in full. Claim no. 34535 belonging to ASM shall be allowed in the reduced amount of $22,000.

2. The default judgment that the PCC obtained against Heritage in adversary proceeding no. 03 A 03135 is hereby deemed satisfied and released.

3. This Order is a final order, and this matter constitutes a core proceeding.
