O'ROURKE v. HUNTER

Decision Pursuant to Rule 1:28.

The order of the Probate Court judge striking the affidavits of objections, and the judgment in Edward O'Rourke, Jr.'s, favor, are reversed. The case is remanded to the Probate Court for proceedings not inconsistent with the memorandum and order of the Appeals Court. Further appellate review granted, 445 Mass. 1105 (2005).
