IT IS STIPULATED AMONG THE PARTIES through their respective counsel as follows:

To the extent any claim set forth in the Third Amended Complaint has been ruled upon by the court, any such ruling shall govern the complaint, except as to plaintiff Thomas, who was not a party to this action when any such rulings were made. As to plaintiff Thomas, any rulings made in Thomas v. Baca, 04-08448-DDP (SHx), shall govern his claims in the Third Amended Complaint in this action.
