IN RE HAMILTON

United States Bankruptcy Court, E.D. Missouri, Eastern Division.
Feb 8, 2006
ORDER

DAVID McDONALD, Chief Judge

This case is before the Court on Debtor's "Motion to Extend Time to File Financial Management Certificate." BAPCPA mandates that an individual debtor may not receive a discharge in a Chapter 7 case unless he completes an instruction course concerning personal financial management. 11 U.S.C. § 727(a)(11). The interim rules promulgate to implement BAPCPA state that the Court may not issue an order discharging Debtor if the Debtor has not filed a certificate indicating that he has completed the instructional course required by 11 U.S.C. § 727(a)(11). Banrk. R. 4004(c)(1)(H). The Court, therefore, finds that neither BAPCPA itself nor the interim rules allow it to extend the time in which a debtor may file his certificate of completion of the course on financial management beyond the discharge date. Accordingly,

The Court notes that Debtor may extend the discharge date by filing a timely motion with the Court. Bankr. R. 4004(c)(2).

IT IS HEREBY ORDERED that Debtor's Motion to Extend Time to File Financial Management Certificate (Motion No. 12) is DENIED.
