On February 27, 2006, the court convened an Order To Show Cause hearing, pursuant to Civil Local Rule 41.1, in this Fair Credit Reporting Act case. Plaintiff's counsel, Harold M. Howell, Esq., appeared and acquiesced in the dismissal. Accordingly, this action is DISMISSED in its entirety, without prejudice, for failure to prosecute.
