On February 16, 2006, this court held a hearing on the parties cross motions for summary judgment. The Trustee, Randy Royal was represented by Ronald P. Jurovich, and the defendant, Sharkey Well Service was represented by Randall T. Cox.

In accordance with the Decision on Cross Motions for Summary Judgment, the court concludes summary judgment for the defendant, Sharkey Well Service, is proper on the complaint brought by the plaintiff/trustee, Randy L. Royal, under 11 U.S.C. § 547.

IT IS, THEREFORE, ORDERED that Sharkey Well Service's Motion for Summary Judgment is granted; the Trustee's Motion for Summary Judgment is denied; and judgment is entered in favor of Sharkey Well Service on the Trustee's Complaint.
