This matter is before the court on Defendants' motion for summary judgment [41] and the Report and Recommendation of Magistrate Judge C. Christopher Hagy [58].

Having read and considered the Report and Recommendation of the Magistrate Judge, the court ADOPTS it as the ORDER of this court. The court GRANTS-IN-PART and DENIES-IN-PART Defendants' motion for summary judgment [41].

The parties are DIRECTED to file a proposed consolidated pretrial order within thirty (30) days of the date of this order.
