For the reasons stated in the Memorandum Opinion filed contemporaneously with this entry, IT IS HEREBY ORDERED, ADJUDGED and DECREED that Defendants' motions for summary judgment (Doc. Nos. 68, 70, and 71) are granted.

FURTHER ORDERED that Plaintiff's motion for partial summary judgment (Doc. No. 72) is denied.

FURTHER ORDERED that Plaintiff's motion to strike (Doc. No. 132) is granted in part and denied in part as stated in the memorandum opinion filed contemporaneously herewith.

FURTHER ORDERED that Plaintiff's motion to file a sur-reply instanter (Doc. No. 137) is granted, and the document is deemed filed.
