Upon consideration of Petitioner Vernon Powell's Motion Under 28 U.S.C. § 2255 to Vacate and Set Aside Sentence by a Federal Prisoner, it is for the reasons set forth in the accompanying Opinion this 15 day of September, 2006,

a) Powell's Motion Under 28 U.S.C. § 2255 to Vacate and Set Aside Sentence by a Federal Prisoner [Paper No. 265], as supplemented [Papers No. 268 and 269] is DENIED;

b) The Clerk shall CLOSE the case; and

c) The Clerk is DIRECTED to MAIL a copy of this Order and the accompanying Opinion to Counsel of Record.
