IN RE RUBIN

United States Bankruptcy Court, N.D. Georgia, Atlanta Division.
Nov 7, 2006
OPINION REGARDING COMPLIANCE WITH § 521(a)

MARGARET MURPHY, Bankruptcy Judge

By order entered September 12, 2006, Debtors were allowed an opportunity to file a written response showing their compliance with the requirements of § 521(a). On September 19, 2006, Debtors filed a written response showing that their apparent failure to comply with the § 521(a)(1)(B)(iv) requirement to file copies of pay advices is justified because, during the 60 days before the petition was filed, neither Debtor was employed by an employer nor received pay advices or other evidence of payment by an employer. Specifically, Debtor Charles Philip Rubin was unemployed and Debtor Bobbie Beth Rubin was self-employed during the applicable period. The proof offered by Debtors is sufficient to satisfy the undersigned that Debtors have complied with § 521(a)(1)(B)(iv).

The Clerk, U.S. Bankruptcy Court, is directed to serve a copy of this opinion upon Debtors, Debtors' attorney, the Chapter 7 Trustee, and the U.S. Trustee.

IT IS SO ORDERED.
