Dear Counsel:

This letter is with respect to the Debtor's objection to the claim of the Division of Waste Management of the North Carolina Department of Environment Natural Resources ("DENR"). (Doc. # 2707.) Subsequent to the January 31, 2007 hearing on this objection, I examined some of the filings from the Debtor's first bankruptcy case (Case No. 00-04211) and discovered some additional information, which I would like counsel for both parties to address.

The Debtor stated in its objection that it mailed notices of the bar date in the first bankruptcy case to the following seven addresses:

I examined the Service List attached to the Affidavit of Service (Case No. 00-04211, Doc. # 600, 601, 602, 603, see attached), which lists all the parties to which the Debtor sent "the PROOF OF CLAIM FORM WITH INSTRUCTIONS," and "the NOTICE OF BAR DATE FOR FILING OF PROOFS OF CLAIM." I found all of the addresses that the Debtor provided in its objection. (Id. at pp. 1249, 1619.) Additionally, I found the following eighteen addresses that also appear to identify DENR or one of its components:

I also found another Affidavit of Service that lists addresses where the Debtor sent "Notice of Commencement of Chapter 11 Bankruptcy Cases, Meeting of Creditors and Fixing of Certain Dates." (Case No. 00-04211, Doc. # 160, see attached.) The Service List attached to that document includes seventeen of the twenty-five total addresses listed in the Service List for the Notice of Bar Dates. Altogether these documents provide evidence that DENR received forty-two notices. (Id. at pp. 291-92, 778, 791-93.)

This document is listed on the docket as # 160, however, the original is labeled as # 159.

I am especially interested in the following address:

NC Division of Waste Management Hazardous Waste Section 1646 Mail Service CTR Raleigh NC 27699-1646

(Case No. 00-04211, Doc. # 600, 601, 602, 603, p. 1227; Doc. # 160, p. 778.) This address appears to correspond with the table attached to the Affidavit of H. Lea Holt, which shows that the "MSC" or Mail Service Center number for the Division of Waste Management is 1646. (Doc. # 2757, Ex. 2, Att. 1.) Please discuss this address along with the others cited above in the filings that I requested at the January 31 hearing.
