For the reasons stated in the memorandum opinion of even date, it is hereby
ORDERED that the motion of Budget for summary judgment on Counts I and III is GRANTED; and it is further
ORDERED that summary judgment is entered against the Plaintiffs on Counts I and III; and it is further ORDERED that Franklin Barnabas' claim for loss of consortium in Count IV is DISMISSED.
