IN RE EDWARD
Appellate Division of the Supreme Court of New York, First Department.
Apr 14, 2009
The court's finding was based on legally sufficient evidence and was not against the weight of the evidence ( see People v Danielson, 9 NY3d 342, 348-349). There is no basis for disturbing the court's credibility determinations, including its rejection of appellant's version of the events. Appellant's intent to cause physical injury could be readily inferred from his act of punching the victim in the face hard enough to knock him unconscious ( see generally People v Getch, 50 NY2d 456, 465).
