For the reasons stated in the accompanying Memorandum Opinion, it is hereby ORDERED that:

(1) Defendants' Motion to Dismiss Count I as it relates Ar Ramadi and Al Asad is DENIED;

(2) Defendants' Motion to Dismiss the remainder of Count 1 is GRANTED;

(3) Defendants' Motion to Dismiss Count 2 is GRANTED;

(4) Defendants' Motion to Dismiss Count 3 is GRANTED;

(5) Defendants' Motion to Dismiss Count 4 as it relates to the time cards of the Ar Ramadi ROWPU employees is DENIED;

(6) Defendants' Motion to Dismiss the remainder of Count 4 is GRANTED;

(7) Relator's Motion to File a Sur-reply is DENIED;

(8) Relator is GRANTED 10 days leave from the date of entry of this order to file a third amended complaint, if he so chooses;

(9) Defendants are GRANTED 20 days from the date of entry of Relator's third amended complaint to file responsive pleadings; and,

(10) the Clerk of the Court shall forward copies of the Memorandum Opinion and Order to all counsel of record.
