Commonwealth v. Miller

Appeals Court of Massachusetts.
Aug 1, 2016

MEMORANDUM AND ORDER PURSUANT TO RULE 1:28

After a jury trial, the defendant, Deborah A. Miller, was found guilty of operating a motor vehicle under the influence of alcohol and negligent operation of a motor vehicle. She appeals, arguing that the evidence was insufficient for a rational trier of fact to conclude, beyond a reasonable doubt, that she was intoxicated and that she operated her motor vehicle negligently so that lives or the safety of the public might be endangered. Our review of the evidence, conducted in the light most favorable to the Commonwealth under the familiar Latimore standard convinces us that the evidence was legally sufficient in both instances. See the argument and authorities set forth in Commonwealth's brief at pages fourteen through twenty-one and pages twenty-two through twenty-three.

See Commonwealth v. Latimore, 378 Mass. 671, 676–677 (1979).
