1. Heard.

2. The land on which the petitioner wants the chak road to be constructed

and continued i.e. Gata No. 420 situated in village Bhaduwa Somvansi,

Pargana, Tehsil & District- Gonda, is banjar land.

3. On being asked, as to how, we can direct a banjar land to be utilized for

construction of a chak marg, no answer could be given. The matter

involves change of category of land and its use, therefore, we asked, the

counsel for the petitioner as to under which provision this can be done

and who is competent to do it, no answer was forthcoming.

4. In view of the above, we decline to interfere in the matter in the

aforesaid circumstances

5. The Public Interest Litigation is disposed of with liberty to pursue

other remedies, if any, available in law.
