CORAM: HON'BLE MR. JUSTICE SANJAY KUMAR DWIVEDI -----
For the Petitioner : Mr. Mantu Kumar, Advocate Mr. Amit Raj, Advocate
For the State : Mr. Ajay Kumar Pathak, A.P.P.
-----
02/25.06.2026 Heard learned counsel appearing for the petitioner and learned counsel appearing for the State.
2. The petitioner is apprehending his arrest in connection with Ramgarh P.S. Case No.89/2026 dated 14.04.2026, registered for the offence under Sections 116(2), 115(2), 118(2), 109(1), 351(2), 352, 3(5) of the BNS, 2023, pending in the Court of the learned C.J.M., Ramgarh.
3. Learned counsel appearing for the petitioner submits that the petitioner runs a tea shop in the town of Ramgarh and the informant's side has encroached upon the land of the petitioner and for that, the petitioner moved before the S.D.O., Ramgarh and pursuant to that, status quo for 60 days has been passed and in spite of that, the informant had encroached upon the land of the petitioner and in view of that, the altercation took place. He further submits that the petitioner has also received injury. To buttress this argument, he refers to Annexure-5 which is the medical prescription issued by the doctor of Rajendra Institute of Medical Sciences, Bariatu, Ranchi. On these grounds, he submits that anticipatory bail may kindly be granted to the petitioner.

4. Learned counsel appearing for the State opposed the prayer and submits that the allegation of assault is there.
5. Considering that in spite of status quo order, the informant has encroached upon some portion of the land of the petitioner and for that, altercation took place and this petitioner has also received injury, which has been supported by Annexure-5 and further, the petitioner is having no criminal antecedent, as disclosed in paragraph 18 of this application and in the attending facts and circumstances of the case, I am inclined to extend the privilege of anticipatory bail to the petitioner.
6. Accordingly, the above-named petitioner is directed to surrender before the learned Court within three weeks from today and in the event of his arrest or surrender, he shall be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M.
