Union Of India v. Subhash Chandra

Madhya Pradesh High Court
Feb 11, 2026

IN THE HIGH COURT OF MADHYA PRADESH

AT JABALPUR

BEFORE

HON'BLE SHRI JUSTICE VIVEK RUSIA &

HON'BLE SHRI JUSTICE PRADEEP MITTAL ON THE 11thOF FEBRUARY, 2026 MISC. PETITION No. 728 of 2026

UNION OF INDIA AND OTHERS

Versus

SUBHASH CHANDRA

Appearance:

Shri Manhar Dixit - Advocate for the petitioners.

ORDER

Per: Justice Vivek Rusia The present petition is filed by Union of India, West Central Railways challenging the order date 09.10.2025, whereby the Central Administrative Tribunal, Jabalpur has allowed the O.A. No.200/1140/2017 by quashing the order dated 25.06.2010, rejecting the candidature of the applicant to the post of Electrical Signal Maintainer Gr.III.

2. This is a third round of litigation. The learned Tribunal, after examining Annexure A/7, which is a revised caste certificate, has certified that the respondent/applicant belongs to the SC community, for the consideration of the office, his case for appointment to the post of Electrical Signal Maintainer Gr.III, if found suitable. The interest of the petitioner department has also been protected by giving the liberty to verify the caste certificate of the applicant before proceeding with the recruitment process.

JUDGE

The verification of the caste certificate means the authenticity of the caste certificate, not the caste.

3. If the respondent produces the caste certificate issued by the competent authority and later on the issuing authority certifies it, then no one can go behind that, except the High Power Scrutiny Committee. Even otherwise, this recruitment is related to the year 2007, and the respondent has travelled upto the Apex Court and got the matter remanded back. We do not find any ground to interfere with the impugned order dated 09.10.2025.

4. Accordingly, the miscellaneous petition is dismissed. ak
