The present bail application under Section 438 Cr.PC. has been

filed seeking anticipatory bail in case crime/FIR No. 277/2023,

under Sections 419/420/406/467/468/471/386/388/120B/34

I.P.C., P.S. Nagram, District Lucknow.

Heard learned counsel for the applicant and learned A.G.A. for

the State as well as Shri Virendra Kumar Mishra, learned

Advocate who has filed vakalatnama on behalf of the

complainant and perused the record.

This anticipatory bail application has been filed directly before

this Court without approaching learned Sessions Court. There is

no exceptional circumstance argued on behalf of the applicant

so as to entertain this anticipatory bail application directly

before this Court.

In view of the full Bench judgment of this High Court at

Allahabad passed in the case of "Ankit Bharti and others Vs.

State of U.P., 2020 (3) ADJ 575 (FB)", the anticipatory bail

application of the applicant is dismissed as not maintainable.

However, liberty is granted him to move appropriate bail

application before the appropriate Court.
