UNITED TELECOMS LIMITED v. THE PRINCIPAL COMMISSIONER OF CUSTOMS
Case Summary: NC: 2024:KHC:37194 — WP No.10256 of 2023 (High Court of Karnataka, Bengaluru)
Factual and Procedural Background
The petition was filed by United Telecoms Limited (represented by Dr. Padmavathi Potluri) under Articles 226 and 227 of the Constitution of India seeking quashment of an Order-in-Original (OIO) bearing No. 925/2022-23 AP and ACC (DIN 20230372MP0000121506) dated 15.03.2023 (Annexure-D) issued by the respondent customs authority, and/or restraint on adjudication of the same. The Show Cause Notice that preceded the impugned OIO is at Annexure-A dated 23.03.2022. The petition came up for hearing before Hon'ble Mr. Justice S.R. Krishna Kumar, who heard learned counsel for both sides and perused the record before passing an oral order on 11 September 2024.
Legal Issues Presented
- Whether the respondent-authority was entitled to rely upon information sourced from Wikipedia in issuing the Show Cause Notice and in passing the impugned Order-in-Original.
- Whether the impugned order should be set aside on the ground that it mechanically or summarily confirmed the demand without properly considering the petitioner's contentions and material on record.
Arguments of the Parties
Petitioner's Arguments
- The Show Cause Notice and the impugned order relied upon information obtained from Wikipedia (referred to in paragraph K of the Show Cause Notice), which the petitioner contended is impermissible in law.
- The petitioner invoked decisions of the Hon'ble Supreme Court — Ponds India Ltd. v. Commissioner of Trade Tax, Lucknow (2008 (227) E.L.T. 497 (S.C.)) and Hewlett Packard India Sales Pvt. Ltd. v. Commissioner of Customs (Import), Nhava Sheva (Civil Appeal No.5373/2019 and connected matters) — to support the submission that reliance on Wikipedia is impermissible.
- The petitioner submitted additional contentions and produced documents (including a reply dated 29.12.2022) which, it is alleged, were not considered by the respondent-authority.
- On these grounds the petitioner sought setting aside of the impugned OIO and remittal for fresh consideration in accordance with law.
Respondents' Arguments
- The respondents supported the impugned order and submitted that the writ petition lacked merit and should be dismissed.
Table of Precedents Cited
| Precedent | Rule or Principle Cited For | Application by the Court |
|---|---|---|
| Ponds India Ltd., vs. Commissioner of Trade Tax, Lucknow - 2008 (227) E.L.T. 497 (S.C.) | Used to support the proposition that reliance upon information obtained from Wikipedia (or similar sources) is impermissible in law. | The court noted the petitioner's reliance on this Apex Court authority to show that the respondent's use of Wikipedia-sourced material was legally impermissible and directed reconsideration in light of such authorities. |
| Hewlett Packard India Sales Pvt. Ltd., vs. Commissioner of Customs (Import), Nhava Sheva - Civil Appeal No.5373/2019 and connected matters | Also cited for the proposition that information from Wikipedia cannot be the basis for formal adjudicatory action. | The court observed that the respondent had placed reliance on Wikipedia in the Show Cause Notice and ordered that the matter be reconsidered afresh by the respondent bearing in mind the judgments of the Hon'ble Apex Court referred to supra. |
Court's Reasoning and Analysis
The court heard learned counsel for both sides and examined the record. It identified that paragraph K of the Show Cause Notice referred to information said to be secured from Wikipedia. The court accepted the petitioner's contention that such reliance on Wikipedia-sourced material is impermissible in law in view of the cited Supreme Court decisions (Ponds India and Hewlett Packard). The court further observed that the impugned OIO mechanically or summarily confirmed the demand stated in the Show Cause Notice without considering the petitioner's various contentions and the documents produced by the petitioner. On that basis, the court concluded that interference by the High Court was warranted.
The court therefore set aside the impugned order and remitted the matter to the respondent-authority for fresh consideration, instructing the authority to provide sufficient and reasonable opportunity to the petitioner — including an opportunity for personal hearing — and to proceed in accordance with law while bearing in mind the Supreme Court judgments relied upon by the petitioner.
Holding and Implications
Holding: The Writ Petition was allowed; the impugned Order-in-Original dated 15.03.2023 (Annexure-D) was set aside and the matter remitted back to the respondent-authority for reconsideration afresh in accordance with law.
Implications:
- The direct effect is that the impugned OIO dated 15.03.2023 no longer stands and the respondent-authority must reconsider the matter afresh.
- The petitioner has liberty to file additional pleadings and documents; the respondent must provide sufficient and reasonable opportunity, including personal hearing, and proceed in accordance with law, bearing in mind the Supreme Court judgments referred to in the petition.
- The court did not purport to lay down any new legal principle; it applied existing Supreme Court authority to invalidate the use of Wikipedia as a basis for the impugned adjudication in this case. No new precedent was set by this order beyond directing fresh consideration consistent with quoted Apex Court decisions.
Order pronounced orally on 11 September 2024 by Hon'ble Mr. Justice S.R. Krishna Kumar. The summary above is based exclusively on the content of the provided opinion.

THIS WRIT PETITION, COMING ON FOR ORDERS, THIS DAY,
ORDER WAS MADE THEREIN AS UNDER:
CORAM: HON'BLE MR JUSTICE S.R.KRISHNA KUMAR
ORAL ORDER
In this petition, the petitioner seeks quashing of the impugned Order-in-original at Annexure - D dated 15.03.2023 passed by the respondents and for other reliefs.
2. Heard learned counsel for the petitioner and learned counsel for respondents and perused the material on record.
3. In addition to reiterating the various contentions urged in the petition and referring to the material on record, learned counsel for the petitioner invited my attention to the Show Cause Notice at Annexure - A dated 23.03.2022 in order to point out that the demand / claim made by the respondent-authority against the petitioner was by placing reliance upon the information collected from Wikipedia, which was impermissible in law, in the light of the judgments of the Hon'ble Apex Court in the case of Ponds India
- 3 -
Ltd., Vs. Commr. of Trade Tax, Lucknow - 2008 (227) E.L.T.497 (S.C.) at Annexure - E and in the case of Hewlett Packard India Sales Pvt. Ltd., Vs. Commissioner of Customs (Import), Nhava Sheva - Civil Appeal No.5373/2019 and connected matter at Annexure - F. It is also submitted that the said contention of the petitioner was taken by him in his reply dated 29.12.2022 in addition to which the petitioner put forth various other contentions in support of his defence. It is the grievance of the petitioner that despite the petitioner specifically pointing out that the respondent was not entitled to place reliance upon the information collected from the Wikipedia and had also put forth various other contentions, the respondent has proceeded to pass the impugned order at Annexure - D dated 15.03.2023 reiterating the demand made in the Show Cause Notice by relying upon the material collected from the Wikipedia, which is impermissible in law and since the respondent did not consider the various contentions / submissions made by the petitioner, the impugned order deserves to be set aside and the matter remitted back to the respondent for reconsideration afresh in accordance with law.

4. Per contra, learned counsel for the respondents would support the impugned order and submit that there is no merit in the petition and the same is liable to be dismissed.
5. As rightly contended by learned counsel for the petitioner, a perusal of the Show Cause Notice dated 15.03.2023 will indicate that at paragraph K of the Show Cause Notice, the respondent has placed reliance on the information said to have been secured from the Wikipedia, which is impermissible in law, in the light of the judgments of the Hon'ble Apex Court referred to supra. So also, a perusal of the impugned order will indicate that despite the petitioner putting forth several other contentions and producing various documents, the same have not been considered by the respondent who has mechanically / summarily confirmed the demand without considering or appreciating the material on record, thereby warranting interference by this Court.
6. In the result, I pass the following:
ORDER
i) The Writ Petition is hereby allowed;
ii) The impugned order dated 15.03.2023 passed by the respondent authority at
- 5 -
Annexure - D is hereby set aside and the matter is remitted back to the respondent - authority for reconsideration afresh in accordance with law.
iii) Liberty is reserved in favour of the petitioner to file additional pleadings, documents etc., which shall be considered by the
respondent, who shall provide sufficient and reasonable opportunity to the petitioner including an opportunity of personal hearing and proceed further in accordance with law, bearing in mind the judgments of the Hon'ble Apex Court referred to supra.
