ORDER

The criminal original petition has been filed to call for the records of the case in C.C.No.53 of 2017 on the file of the learned Additional Mahila Court, Perambalur and quash the order dated 14.09.2021 committing the above case to the Principal Sessions Court, Perambalur. 2.The learned counsel appearing for the petitioners submitted that in the deposition of PW1 & PW2, the ingredients of 376 and 306 r/w 109 IPC and 294 (b), 506(ii) IPC are not made out, so, committing the case to the Principal Sessions Court is unwarranted. Therefore, challenging the impugned order dated 14.09.2021 passed in C.C.No.53 of 2017 on the file of the Additional Mahila Court, Perambalur, the present criminal original petition has been filed.

3.The learned Government Advocate (Crl.side) appearing for the respondent submitted that after committal to Principal Sessions Court, Perambalur, the learned Sessions Judge has taken cognizance in S.C.No.41 of 2021 and now posted for framing of charges.

4.I have considered the matter in the light of the submissions made by the learned counsel for the petitioner as well as the learned Government Advocate (Crl.side) for the respondent and perused the materials available on record.

5.On perusal of records, it is noticed that the respondent police had filed final report against the accused under Sections 417, 294(b), 506(ii),

109 IPC and cognizance taken on 19.06.2017 under Sections 417, 294(b), 506(ii) r/w 109 IPC. Charges framed against the 1staccused under Sections 417, 294(b), 506(ii) IPC, and against the 2ndAccused under Sections 294(b), 417 r/w 109 IPC and against the 3rdaccused under Sections 294(b), 417 r/w 109 IPC. On 24.08.2017, this case was posted for trial. PW1, PW2 and PW3 were examined on 10.07.2018. PW2 was examined on 22.10.2018. PW4, PW5 and PW6 were examined on 17.12.2018. PW1, PW2 and PW3 were cross examined on 22.10.2018 and this case is posted for issue summon to LW7 to LW12 on 14.09.2021. After recording the evidence of PW1, PW2 & PW3, the learned judge found that the evidence disclosed the offences under Sections 376 and 306 r/w 109 IPC,

hence, by invoking Section 323 Cr.P.C committed it to Principal Sessions Court. I have gone through the deposition of PW1 to PW3 and the learned Judge also extracted the evidence of PW1;

6.Under these circumstances, based upon the evidence of PW1 to PW3, the learned Magistrate was satisfied that the evidence disclosed the cognizable offence, hence, the learned Magistrate has committed the case to the Court of Sessions, in which, I find no infirmity and there is no reason to interfere with the order dated 14.09.2021 passed in C.C.No.53 of 2017 by the learned Magistrate and I find no merit in the criminal original petition. Accordingly, the criminal original petition is dismissed. Consequently, connected miscellaneous petition is closed.
