Heard learned counsel for the petitioner and the learned AGA.

This petition has been filed by the petitioner Saya Pal Singh with a

prayer that suitable direction be issued to the authority concerned not to

arrest the petitioner in CB No. 623 of 2007 - CBCID Gorakhpur Sector

Gorakhpur (Case Crime No. 366/2007 under sections

419/420/467/468/471/120-B/218 IPC P.S. Shahpur district Gorakhpur.

From the perusal of the writ petition, it reveals that it is a case in which

the First Information Report has been registered against the petitioner

and other co-accused person but during investigation, the name of the

petitioner came to light. In such circumstances, a blanket stay for his

arrest, as prayed for, can not be granted.

However, considering the nature of allegations made in the FIR, it is

directed that in case the petitioner appears before the Court concerned

within 30 days from today and apply for bail, the same shall be heard

and disposed of expeditiously, if possible, on the same day by the

courts below.

With the above direction, this writ petition is finally disposed of.
