When the matter is taken up for hearing, Mr. B.Y. Mankad,

learned advocate for the appellants, under the instructions seeks

permission to withdraw Second appeal along with the Civil

Application for stay.

Learned advocate Mr. Ekrama Qureshi, has remained

present though his name is not reflecting on Board in Civil

Application, but was appearing in the proceedings for some of

the contesting defendants.

In view of the above, both second appeal and civil

application stand disposed of as withdrawn.
