Union Of India And Others v. State Of Maharashtra And Others

Bombay High Court
Feb 7, 2020
Smart Summary (Beta)

Factual and Procedural Background

This writ petition challenges a certificate issued by the Industrial Court at Mumbai on an application under section 50 of the Maharashtra Recognition of Trade Unions and Prevention of Unfair Labour Practices Act, 1971 (MRTU and PULP), and the attachment orders made by authorities pursuant to that certificate.

The petition is filed by the Union of India on behalf of the United Nations Children Fund (UNICEF), the party affected by the impugned order. The petitioner contends that, under the United Nations (Privileges and Immunities) Act, 1947, the United Nations and its property and assets enjoy immunity from legal process, which is the primary ground of challenge to the certificate and the consequent attachment orders.

Legal Issues Presented

  1. Whether, under the United Nations (Privileges and Immunities) Act, 1947, the United Nations (here represented by UNICEF) and its property and assets enjoy immunity from legal process such that the Industrial Court's certificate and consequent attachment orders are impermissible.
  2. Whether, in light of the contention of immunity, interim relief in the form of a stay on the impugned orders is warranted pending final hearing.

Arguments of the Parties

The opinion does not contain a detailed account of the parties' legal arguments.

Table of Precedents Cited

No precedents were cited in the provided opinion.

Court's Reasoning and Analysis

The court observed that the petitioner's contention — that the United Nations (Privileges and Immunities) Act, 1947 confers immunity on the United Nations and its property from legal process — had prima facie merit. On that basis the court concluded that the petition deserved to be considered at a full hearing.

Procedurally, the court issued notice for final hearing, making the matter returnable on March 3, 2020. The court recorded that the learned Additional Government Pleader (representing certain respondents) waived service.

As an interim measure pending final hearing, the court stayed operation of: (a) the impugned judgment and order dated June 26, 2019; (b) the Recovery Certificate dated July 29, 2019; and (c) the attachment order passed in respect of UNICEF's bank account. The stay preserves the status quo on enforcement and attachment pending adjudication of the immunity claim.

Holding and Implications

INTERIM STAY GRANTED

Holding: The court granted an interim stay of the impugned judgment and order dated June 26, 2019, the Recovery Certificate dated July 29, 2019, and the attachment order relating to UNICEF's bank account. The court issued notice for final hearing on March 3, 2020 and recorded waiver of service by the learned AGP for the State.

Implications: The direct effect is that enforcement steps and the attachment of UNICEF's bank account are stayed until the matter is finally heard. The opinion does not state or establish any broader legal precedent beyond the interim relief; it confines itself to noting prima facie merit in the immunity contention and ordering further proceedings.

S.C. Gupte, J.:— This writ petition challenges the certificate issued by the Industrial Court at Mumbai on an application under section 50 of the Maharashtra Recognition of Trade Unions and Prevention of Unfair Labour Practices Act, 1971 (MRTU and PULP) and the attachment orders issued by the authorities in pursuance of that order.

2. Essentially, the grievance of the party affected by the impugned order, namely, United Nations Children Fund (UNICEF), on whose behalf the present petition is filed by the Union of India, is that under the United Nations (Privileges and Immunities) Act, 1947, United Nations and its property and assets, wherever located and by whomsoever held, enjoy immunity from every form of legal process. There is clearly prima facie merit in the contention. The petition deserves to be considered.

3. Issue notice accordingly for final hearing. Notice is made returnable on March 3, 2020.

4. Learned AGP for the State (representing Respondent Nos. 1, 2 and 3) waives service.

5. In the meantime, the impugned judgment and order on June 26, 2019 and Recovery Certificate dated July 29, 2019 as well as the attachment order passed in respect of the bank account of UNICEF shall remain stayed.
