Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased to direct the respondents 4 to 6 to allow the petitioner to appear for AP EAMCET-2020 examination scheduled to be held on 18.09.2020 or any other date under SC category without insisting for production of attested copy of his caste certificate but basing on the caste certificates of his father & grandfather., and pass Pending disposal of WP No. 16433 of 2020, on the file of the High Court.

The court while directing issue of notice to the Respondents herein to show cause as to why this application should not be complied with, made the following order. (The receipt of this order will be deemed to be the receipt of notice in the case). The Court made the following:

D. Ramesh, J.:— “Heard the learned counsel for the petitioner and the learned Government Pleader for Social Welfare.

2. Learned Government Pleader submits that as per the notification dated 17.07.2018 the jurisdiction with regard to issuance of community certificate under the Andhra Pradesh (SCs, STs and BCs) Regulation of issue of Community Certificates Act, 1993 is within the territorial jurisdiction of a Mandal in the Districts of Hyderabad, Ranga Reddy, Mahabubnagar, Adilabad, Nizamabad, Medak, Karimnagar, Warangal, Khammam and Nalgonda, but the petitioner is residing in Kurnool District and that there is no Budaga Jangam caste in Kurnool District for issuance of Caste Certificate.

3. It is brought to the notice of this Court by the learned counsel for petitioner that in identical circumstances, this Court on 26.12.2018, passed an interim order in I.A. No. 1 of 2018 in W.P. No. 31316 of 2018.

4. Since this Court has taken in view and passed an interim order in W.P. No. 31316 of 2018, there shall be the following interim order in this case also, subject to result of the main writ petition.

5. “There shall be interim direction to respondent Nos. 4 to 6 to allow the petitioner to appear for AP EAMCET-2020 examination scheduled to be held on 18.09.2020 or any other date under SC category without insisting for production of attested copy of his caste certificate, but basing on the caste certificates of his father and grandfather.”
