Manoj Kumar And Others v. State Of Himachal Pradesh Through Principal Secretary And Others

Mohammad Rafiq, C.J.:— This writ petition has been filed by the petitioners, inter alia, with a prayer that the respondents be directed to bring their services on contractual establishment against the post of Pump Attendant immediately on completion of 12 years service as Water Guard, in the time scale of pay from due date along with all consequential benefits.

2. This issue is no longer res-integra, as the same has been decided by the Division Bench of this Court in LPA No. 104 of 2021, titled State of H.P. v. Jagdish Kumar on 23.02.2022, by upholding the judgment passed by the learned Single Judge in CWP No. 3047 of 2020, titled Jagdish Kumar v. State of Himachal Pradesh.

3. The writ petitioner is, therefore, allowed in terms of the aforesaid judgment and the respondents are directed to extend similar benefits to the petitioners as well, if their case is covered by Jagdish Kumar's (supra), within a period of three months from the date of production of a copy of this judgment.
