The petitioner is seeking direction to the respondents to issue interest on account of delayed payment of refunds for the years 2010-11 and 2011-12 for 1750 days and 1405 days as the refund was issued on 24.10.2019 and 26.06.2019 respectively. However the same was to be issued within a period of 60 days from the date of filing of refund applications as per Section 20 of the Haryana VAT Act, 2003 read with Rule 41 of the Haryana VAT Rules, 2003. The petitioner has given applications vide email dated 07.08.2018 (Annexure P-7) and 14.11.2019 (Annexure P-9) for claiming interest on account of delayed refund for the years 2010-11 and 2011-12 which have not been decided till date. CWP-3991-2021 -2- Without expressing any opinion on the merits of this case, this petition is being disposed of by giving direction to the respondents to decide applications filed vide email dated 07.08.2018 (Annexure P-7) and 14.11.2019 (Annexure P-9) by passing a speaking order within a period of four weeks from the date of receipt of certified copy of this order and if the petitioner is found entitled to interest on the delayed refund for the years 2010-11 and 2011-12, the same shall be released within the next four weeks.
