Prabal Pratap Yadav v. Rajasthan Rajya Vidy...

Rajasthan High Court
Nov 5, 2019

Sanjeev Prakash Sharma, J.:— The petitioner claims consideration for appointment on the post of Junior Engineer-1 (Fire & Safety) on the basis of holding one year diploma in industrial safety which he has secured from Bharat Sevak Samaj. The said course has not been recognized by the Board of Technical Education Rajasthan and therefore the respondents rejected the candidature of the petitioner for appointment on the post of Junior Engineer-1 (Fire & Safety).

2. Counsel appearing for the Board of Technical Education Rajasthan submits that the Board has recognized a three years Diploma alone. The petitioner has not placed on record the document that would show that the Diploma in Industrial Safety which is recognized by Bharat Sevak Samaj is recognized anywhere as equivalent to full-time Diploma in Industrial Safety.

3. This Court does not have expertise to grant equivalence of course concucted by different institutions of Board of Technical Education, as been affirmed for the said purpose. The qualification laid down under the advertisement reads as under:—

“5. Fire & Safety-The candidate must hold four years' Full Time Graduation Degree in Engineering as a regular student or AMIE; or equivalent from a University/Institution established by Law in India and recognized equivalent to full time Graduation Degree in Engineering by AICTE, New Delhi in:—

(i) Fire Fighting/Industrial Safety Engineering.

(ii) Mechanical/electrical/Production Engineering with full time Diploma in Industrial Safety from a University/Institution.”

4. It is apparent that the petitioner does not possess the full time three years Diploma in Industrial Safety from a University/Institution. In view thereof, claim made by the petitioner is not made out.

5. The writ petition being devoid of merit is accordingly, dismissed. All pending applications are disposed of.
