Bombay High Court
Dec 19, 2019

1. Heard. The petitioners state that the Deed of Declaration has been registered as per the Maharashtra Apartment Ownership Act, 1970 on 9 August 2016 and as such formation of cooperative society ignoring that aspect and that too without any opportunity to the petitioners is unsustainable.

2. Learned counsel appearing for respondent No. 4 is strongly opposing an intervention of this Court. She submits that the order of Registrar for formation of cooperative society has been questioned by the developers before the learned Single Judge and the petitioners are approaching this Court at the fag end and that too at eleventh hour without giving any notice to the respondents.

3. The coordinate Bench of this Court as on 18 December 2019 expressed inability to take up this petition and therefore, it is placed before us today.

4. In this situation, we direct the parties to maintain status quo as on today. List the petition for further consideration on 6 January 2020.

5. Ms. Pranita Hingomira, learned counsel waives notice for respondent No. 4. R.P.A.D./Hamdast for completing service upon remaining respondents.
