Social Action For Forest & Environment (Safe) v. Union Of India

This execution application has been filed by the applicant purporting to be for compliance of our order 06.12.2018. On that day, we had disposed of the original application after taking note of I.A. 67652/2018 filed by National Chamber of Industries and Commerce in M.C. Mehta v. Union of India ((1997) 2 SCC 353 : AIR 1997 SC 734) wherein certain directions were given to the Principal Secretary, Department of Industries, Government of Uttar Pradesh.

In view of the circumstances, we had observed that the applicant should approach the Hon'ble Supreme Court or the Principal Secretary of Industries Department, Government of Uttar Pradesh, in furtherance of the order passed in I.A. No. 67652/2018.

However, instead of taking appropriate steps as per the aforesaid orders passed by the Tribunal, the applicant has filed this execution application which according to us is misconceived. The applicant must approach the Hon'ble Supreme Court for seeking directions which he desires.

Accordingly, execution application no. 01/2020 in original application no. 391/2015 stands disposed of.
