Jan 1, 2018

S.K. Mohanty, Judicial Member:— The applicant has filed this Miscellaneous Application, seeking rectification of mistake in the Final Order No. 56526/2016 dated 11.08.2016.

2. Heard both sides.

3. On perusal of the impugned order and the other papers available in the file, I find that the Tribunal vide Final Order dated 30.11.2012 has remanded the matter to the Adjudicating Authority for re-quantification of the demand, after extending the benefit of Cum-Duty Price. Since the Cum-Duty benefit pursuant to the order dated 30.11.2012 has not been granted by the authorities below, the Tribunal vide Final Order dated 11.08.2016 has set aside the impugned order to the extent of allowing the Cum-Duty benefit to the appellant. Since the impugned order dated 11.08.2016 was passed in line with the earlier order dated 30.11.2012, I do not find any mistake in the Final Order dated 11.08.2016 passed by this Tribunal. Accordingly, the ROM application filed by the applicant is dismissed.
