Manjula Singh Chouhan v. Vishal Singh Chouhan .
Factual and Procedural Background
The Supreme Court was asked to review a decision dated 21-7-2016 of the High Court of Madhya Pradesh, which had refused to transfer HMA Case No. 71 of 2016 from the Family Court, Indore, to the Family Court, Bhopal. The appellant noted that two other matrimonial matters between the same parties were already pending before the Family Court in Bhopal, whereas the respondent preferred that the case remain in Indore. The present civil appeal seeks transfer so that all matrimonial disputes between the parties may be heard at a single forum.

No precedents were cited in the provided opinion.
Court's Reasoning and Analysis
The Court observed that, regardless of the respondent’s objections, the respondent would still need to travel to Bhopal to attend hearings in the other two pending matrimonial cases. The Court concluded that judicial economy and the convenience of both parties would be best served if all related cases were heard by the same Family Court. It therefore deemed consolidation in Bhopal appropriate and in the interests of justice.
Holding and Implications
HOLDING: HMA Case No. 71 of 2016 is transferred from the Family Court, Indore, to the Family Court, Bhopal. The Family Court, Bhopal, is directed to dispose of all matrimonial cases between the parties expeditiously, preferably within one year. The civil appeal is disposed of on these terms.
Implications: The immediate effect is procedural consolidation, reducing duplication of proceedings and travel for both parties. The decision does not establish a new legal precedent beyond reaffirming the Court’s discretionary power to order transfers in the interest of justice.
Kurian Joseph, J.— Leave granted. This appeal has been filed against the order dated 21-7-2016 passed by the High Court of Madhya Pradesh in Manjula Singh Chouhan v. Vishal Singh Chouhan 2016 SCC OnLine MP 12056 declining to transfer HMA No. 71 of 2016 from the Family Court, Indore to Family Court, Bhopal.
2. As per the submission of the appellant, two cases are already pending in the Family Court, Bhopal, and it will be in the interest of both the parties to try all their cases in Bhopal. The learned counsel for the respondent however, submits that it will suit the appellant only, therefore, transfer may not be permitted. The fact remains that the respondent has to travel to Bhopal for conduct of other cases pending in the Family Court, Bhopal.
3. We are of the view that it will be in the interest of both the parties that all their cases be heard together by the same Court. Therefore, HMA Case No. 71 of 2016 is transferred from the Family Court, Indore to the Family Court, Bhopal. We direct the Family Court, Bhopal to try and dispose of all the cases pending between the parties expeditiously preferably within one year.
4. The civil appeal is disposed of in the aforesaid terms.
