Ex. Wo Ram Charan v. Union Of India & Ors.

Petitioner vide this petition has prayed for quashing of order (Annex A-1 & A-2 colly). It is also prayed that respondents be directed to pay disability pension duly rounded off to 75% with interest @ 12% per annum and to carry re-survey medical for increased disability.

Learned counsel for the respondents submits that petitioner's disability for Primary Hypertension has been assessed to 30% by the medical board and the disability pension to this extent will be released to the petitioner in view of changed policy vide letters dated 29.09.2009 and 03.08.2010.

We hope and trust that authorities will release disability pension to the petitioner as per recommendation of the medical board in the light of letters dated 29.09.2009 and 03.08.2010 as far as possible within a period of three months from date of this order. Petitioner will also be entitled for interest @ 12% per annum on arrears. With these observations, petition stands disposed of.
