Ex Lance Nk Om Prakash v. Union Of India & Ors.

1. One review application has been filed before the Lucknow Bench of the Tribunal by the UOI against the order dated 23.09.2011 passed in OA 275/2011. The order sought to be reviewed was passed by the two-Members of the Regional Bench of the Lucknow of the Armed Forces Tribunal and both have retired. One execution application has been filed by the petitioner of the OA 275/2011, who is present in person today. That execution petition is pending before the other two members of the Tribunal. Since the Members who passed the order in OA 275/2011 have already retired upon superannuation, therefore, the review application can be heard by any of the Bench including the Bench where the execution petition is pending.

2. Therefore, the review application MA No. 118/2013 filed in OA 275/2011 be placed before the Bench for hearing the execution matter. The MA is allowed accordingly.
