Applicant has filed the present Original Application praying therein: 8.1 Set aside and quash order dated 01-06-2012. 8.2 To direct the respondents to enhance the subsistence allowance of the applicant from 50% to 75% from due date. 8.3 To direct the respondent to grant all the consequential benefits, seniority, promotion and arrear to the applicant. 8.4 Any other relief deems fit and proper may also be granted.

2. Today, Smt. Oberoi, learned counsel for the respondents produced before me a copy of order No. 7/261/S/TGT/NGV/ VIG/2010/ 4503-4509 dated 8.3.2013 whereby penalty of compulsory retirement has been imposed upon the applicant and also a copy of order No.DE.7/561/TGT/Vig/ 2011/ dated 15.11.2012 issued by the competent authority revoking the suspension of the applicant. Respondents have also issued a speaking order No. DDE (S)/50/10//Z-23/ Court Case/2012/ 261-265 dated 28.2.2013 dealing with the claim of the applicant for enhancement of subsistence allowance.

3. In view of the said orders, Shri Yadav, learned counsel for respondents seeks permission to withdraw the present Original Application with liberty to file fresh one seeking appropriate reliefs.
