Amar Singh Petitioner v. H.P Subordinate Services Selection Board And Another S
Deepak Gupta, J. (Oral).
1. The Short question involved in this case is whether the diploma in Hindi Teacher Education Course obtained by the petitioner from Bharat Sewak Samaj (hereinafter referred to as the BSS) is recognized or not.
2. On 21.6.2011 a specific direction was given to the respondent to file an affidavit as to whether the special diploma in Hindi Teacher Education Course is equivalent to Language Teacher Training in Himachal Pradesh or not. An affidavit has been filed by the Secretary Education clearly stating that this diploma is not being considered to be equivalent to the Language Teacher Training Course being run in Himachal Pradesh. This is a policy matter in which the Court cannot interfere.
3. Shri Neel Kamal Sharma, learned counsel for the petitioner has relied upon the certificate issued by the Bharat Sevak Samaj, which gives an indication that BSS was started at the instance of the Planning Commission, Government of India, after approval of the Parliament. Bharat Sevak Samaj is not a party before this Court. If BSS or its other affiliated institutions have misled the petitioner then the remedy of the petitioner is to file appropriate proceedings against the said authority but this cannot be a ground to grant equivalence. Therefore, this petition is rejected with liberty reserved to the petitioner to take appropriate action against the institution where he studied as well as the Bharat Sevak Samaj.
No costs.
