I.A No. 15478/2014 is made seeking amendment in the return to correct the typographical error.

On due consideration, I.A aforesaid stands allowed.

Let the amendment be incorporated in the return within two working days.

Though virtually the entire claim of the petitioner is admitted, but only this much is said that the Departmental Promotion Commitee has not found the petitioner eligible to be promoted on the next post, therefore, his claim was not considered for such promotion. Such a stand of the respondents is not proper to adjudicate the claim made by the petitioner. Respondents to look into this and to file a categorical statement on affidavit what were the reasons of not finding the petitioner eligible for such promotion within two weeks, failing which the writ petition would be heard without such additional affidavit of the respondents.
