Protap Chandra Mandal v. Ishan Chandra Chowdhry
Calcutta High Court
May 11, 1898
This case was remanded for a finding to the lower Court on the question as to whether a certain mortgage transaction was genuine or not. The Sub-Judge has found it was genuine, and the result is that the only interest the Plaintiffs have in the property is the right to redeem it. They have, therefore, no right to the decree which the lower Court has given them. We decree this appeal, setting aside the decree of the lower Court and restoring that of the first Court, dismissing the suit with costs in all the Courts.
